Bill Cosby asks state Supreme Court to review and dismiss sex assault case

Attorneys for comedian Bill Cosby are asking the California Supreme Court to dismiss a lawsuit filed by a woman who claimed he molested her at the Playboy Mansion in 1974, when she was 15.

The petition for review was filed Tuesday after the Court of Appeals rejected Cosby’s request to reverse a lower’s court decision to allow Judy Huth to continue with her case.

Calls to Cosby’s attorney were not immediately returned.

According to Huth’s lawsuit, she and a 16-year-old friend met the comedian in 1974 at a San Marino park. Later, she said Cosby gave her alcohol and led her to the mansion, where the attack allegedly occurred.

Huth’s case is one of a string of sexual assault accusations made against Cosby.

The Los Angeles County district attorney’s office declined to file charges against Cosby, 77, in December because the 40-year-old case is past the statute of limitations.

“Therefore, prosecution today for any potential felony sex crime from 1974 would also be barred,” the D.A. said in a court document.

Huth’s attorney, Gloria Allred, said she plans to file an opposition, fighting Cosby’s petition.

“We look forward to continuing to fight for Ms. Huth’s right to have her allegations against Mr. Cosby decided at trial in the Los Angeles County Superior Court,” she said in a statement.
