Just weeks ago, Brooke Mueller and Charlie Sheen‘s twin sons were being taken from Dad and shuttled off to Mom because Dad was acting just a little nutty. Now the tables may be turned, with Mueller reportedly back in rehab after refusing a drug test and Sheen possibly heading to court to seek custody.
Lawyers for Sheen, who pays Mueller $55,000 a month in child support, gave a heads-up Monday to Team Brooke that the former ‘Two and a Half Men’ star would be in court Tuesday to ask for full custody, TMZ said. The site reported Sunday that Mueller had gone back to rehab as a preemptive strike in her bid to keep the kids.
Mueller and Sheen are both required to pass drug tests as part of their recently renegotiated custody agreement, and a refusal counts as a failure. He filed for divorce in February.
On Thursday, Mueller was reportedly calling around for a clean urine sample, Radar Online said, and on Friday she refused to be tested, according to TMZ. She was also seen on security video Thursday at an Inglewood pawn shop, where she unsuccessfully attempted to hock a couple of big-ticket items, an employee of the shop told TMZ.
A source close to Mueller told Radar that she won’t give up the boys without a fight, because with Sheen on the road with his ‘My Violent Torpedo of Truth’ tour, ‘The last place the twins should be is in a different hotel rooms every night.’ Charlie’s final tour date is May 3, a little more than two weeks away.
Mueller did a rehab stint at the Canyon in Malibu about a year ago but moved to at-home rehab after details of her admission were leaked. At the time, Sheen was in ‘preventative rehab’ after his Christmas 2009 arrest in Aspen on domestic violence charges. Sheen did his own at-home rehab more recently after his erratic behavior and a trip to the hospital got him suspended from ‘Two and a Half Men.’ It was at home — a.k.a. the Sober Valley Lodge — that he cured himself ‘in the blink of an eye,’ he said. He lost his sitcom job nonetheless.
Meanwhile, 2-year-old Bob and Max are reportedly in the custody of ‘Brooke’s extended family’ in L.A., and Sheen ‘goddess’ Rachel Oberlin (porn name Bree Olson) has again left Charlie, bailing out of his tour in the middle of the night, perhaps because she was homesick or perhaps because she wanted to have sex with people who weren’t Charlie, depending on which part of Sheen’s on-stage explanation you choose to believe.
